Terms & Conditions – Talia’s Boutique Sydney

Article 1 – Definitions

Cooling-off period: The period in which the consumer may exercise their right of withdrawal.
Consumer: A natural person who is not acting in a professional or commercial capacity and who enters into a distance agreement with the entrepreneur.
Day: Calendar day.
Ongoing transaction: A contract covering a series of products/services with obligations spread over time.
Durable data carrier: Any tool that allows the consumer or entrepreneur to store information for future reference and unaltered reproduction.
Right of withdrawal: The consumer’s right to cancel the distance contract during the cooling-off period.
Entrepreneur: Talia’s Boutique Sydney – the legal entity offering products at a distance.
Distance contract: An agreement concluded remotely via an organised sales system without in-person interaction.
Technology for remote communication: Tools enabling remote contract conclusion.
General Terms & Conditions: These terms as outlined by the entrepreneur.

Article 3 – Applicability

These Terms & Conditions apply to every offer from Talia’s Boutique Sydney and to every contract concluded between the consumer and Talia’s Boutique Sydney.

Prior to concluding a distance contract, the text of these Terms & Conditions will be made available. If not reasonably possible, we will inform you where the Terms can be viewed and send them upon request.

For electronic agreements, these Terms will be provided in a format that can be stored and accessed for future reference.

If additional terms apply to specific products or services, the consumer may rely on the most favourable applicable provision in case of conflicts.

Should any clause be deemed invalid, the remaining clauses shall remain effective.

Any unforeseen circumstances will be interpreted in the spirit of these Terms.


Article 4 – The Offer

If an offer is time-limited or conditional, this will be clearly stated.

Offers are non-binding. Talia’s Boutique Sydney reserves the right to modify or withdraw offers at any time.

All offers include a clear and complete description of the products. Images represent the product as accurately as possible but slight variations may occur.

Offer details include:

  • Price (excluding GST and import duties)

  • Shipping costs

  • Steps required to complete the purchase

  • Right of withdrawal (if applicable)

  • Accepted payment methods

  • Delivery and fulfilment information

  • Validity of the offer

  • Language availability for the contract


Article 5 – The Contract

The contract is concluded once the consumer accepts the offer and meets the stated conditions.

Talia’s Boutique Sydney will confirm acceptance electronically.

We ensure secure digital data handling and website safety.

We may verify a consumer’s ability to fulfil payment obligations within legal boundaries.

Upon contract completion, the consumer will receive:

  • Contact details for customer service

  • Instructions on withdrawal rights

  • Information about aftercare or guarantees

  • Termination terms for ongoing contracts

All agreements are subject to product availability.


Article 6 – Right of Withdrawal

Consumers may cancel their purchase within 14 days without stating a reason.

During this period, consumers must handle products and packaging with care.

To withdraw, consumers must notify Talia’s Boutique Sydney within 14 days after receipt.

Returns must be shipped within 14 days after notification, with proof of shipment provided.


Article 7 – Return Costs

Return shipping costs are the consumer’s responsibility.

Refunds will be processed within 14 days of withdrawal notification, provided the returned product is received in good condition.


Article 8 – Exceptions to Withdrawal

The right of withdrawal does not apply to:

  • Custom-made or personalised items

  • Perishable goods

  • Sealed items unsuitable for return due to hygiene

  • Digital goods/services once used or accessed


Article 9 – Pricing

Prices remain fixed during an offer’s validity, unless GST rates change.

Talia’s Boutique Sydney is not liable for obvious typographical pricing errors.


Article 10 – Conformity and Warranty

All products conform to descriptions provided.

Manufacturer warranties apply where relevant.

Warranty is void if:

  • Products are misused

  • Products are altered or repaired without permission


Article 11 – Delivery and Fulfilment

Talia’s Boutique Sydney aims to fulfil orders with care and efficiency.

Products will be delivered to the address provided by the consumer.

If unexpected delays occur, consumers will be informed within 30 days and may cancel free of charge.

Liability for damage transfers to the consumer upon delivery.


Article 12 – Ongoing Agreements

Consumers may cancel ongoing contracts with one month’s notice.

Fixed-term contracts will not be automatically renewed.


Article 13 – Payment

Payment is due within 7 working days unless otherwise agreed.

Consumers must report any payment errors immediately.


Article 14 – Complaints

Complaints must be submitted within 7 days of discovering the issue.

We aim to respond to complaints within 14 days.

If a resolution cannot be reached, legal steps may be pursued.


Article 15 – Legal Jurisdiction

All contracts are governed by Australian law.


Article 16 – CESOP Regulation

In line with EU CESOP regulations (2024), payment service providers may share transaction data with European authorities when applicable.
